Harassment At Work

Workers should feel safe on the job without having to face harassing comments from their co-workers and supervisors. California has strict laws in place aimed at protecting workers from bullying, unwanted sexual advances and other serious forms of harassment. A skilled lawyer can help you understand your options and fight back against those who violated your rights.

I am Jose A. Gonzalez, Attorney at Law. At my South San Francisco law firm, I offer aggressive employment advocacy for workers in all industries throughout the Bay Area. I know how difficult it is to experience workplace harassment. I foster a caring and understanding atmosphere to help you feel more comfortable throughout the process, all while pursuing a just outcome on your behalf.

What Is Considered Workplace Harassment?

Workplace harassment can take on several different forms, including sexual harassment, race-based harassment, and religious harassment. Workplace harassment applies to any unwelcome conduct based on protected characteristics that include, but are not limited to:

  • Race
  • National origin
  • Sex
  • Gender
  • Sexual orientation
  • Religion
  • Age
  • Disability

Do I Have A Claim?

Not all forms of harassment may rise to the level of illegality. A minor incident or small annoyance generally does not rise to the level of harassment. To file a workplace harassment claim, the conduct must meet one of the following criteria:

  • Abiding by the ongoing harassing conduct is a requirement for keeping your job
  • The conduct is so severe that it creates a hostile work environment

As a solo practitioner, I can offer one-on-one counsel while being responsive to your questions and concerns. I genuinely care about your well-being, which is why I work so hard to obtain the outcome you deserve to your harassment claim.

It is against the law for your employer to retaliate against you if you file a harassment claim. If your employer fires you, reduces your hours or otherwise punishes you for coming forward, I will work hard to hold them accountable for their illegal actions.
