California's Overtime Laws

California has some of the most worker-friendly overtime laws in the country. The overtime rate must be at least 1.5 times your base hourly pay rate.

Nonexempt workers may be eligible for either daily or weekly overtime pay if:

  • Daily: Work more than eight hours in a single day
  • Weekly: Work more than 40 hours in a single week

Employers may use several tactics to avoid paying you the full rate you deserve. They may exchange overtime pay with future time off or force you to work off the clock. These actions are illegal. I provide fierce advocacy that seeks to recover every dollar you worked for.

Did Your Employer Misclassify You?

One additional method employers use to underpay workers is to misclassify them as exempt, salaried workers. Exempt workers are ineligible for overtime pay, mandatory lunch breaks and other benefits offered to nonexempt workers.

California has clear rules outlining which positions should and should not be classified as exempt. I will personally review your situation to determine whether you have a misclassification claim.
